Abstract
The paper presents definitions of „charge" and „prosecutor" in the criminal proceedings, then-reviews the traditional systems for preparing a criminal case to trial. It points out the differences between the continental „preliminary investigation" and Judicial examination" on the one hand, and the Anglo-Saxon „preparing a case for the prosecution" by the police on the other, as well as the differing relations of the prosecuting agencies in their regard. It discusses also the rise of public prosecuting agencies in Scotland, England and Wales, Northern Ireland, the Irish Republic, and the differences in the roles, rights and duties of prosecutors during the police investigation in continental as opposed to the Anglo-Saxon jurisdictions, and, finally, analyses the process of prosecutorial decision-making in both systems.
