Abstract

The Arctic is the most specific area of the world with its surface of almost 25 square kilometers of half-frost ocean surrounded by the desolate tundra of Eurasia and North America. Under the ice the Earth's largest target of untouched mineral treasures is hidden in the continental shelf and as an effect of global warming it is getting more and more easy to reach and exploit it. These works and the circumpolar transport which is also becoming frequent with the collapse of icy burdens cause the pollution of this very sensitive area in which the self-cleaning procedure of the nature differs from that of other places of the planet needs to be protected by specific legal instruments of international law. The only generally applicable provision applying expressly to this polar area is Article 234 of the 1982 Law of the Sea Convention, entitled "Ice-covered areas". This affirms the right of the coastal States to adopt and enforce nondiscriminatory laws and regulations for the prevention, reduction and control of marine pollution from vessels in ice-covered areas within the limits of the exclusive economic zone, bearing in mind the special geographic conditions of these sea areas. Such regulations shall have due regard to navigation and the protection and preservation of the marine environment based on the best available scientific evidence.In the essay the existing legal protection is examined from the basics: the principles of environemental protection against pollution, the ineffective international standards, through the national approach, the road to the birth of the insufficient but milestone Article 234 of UNCLOS, to the commencement of regional cooperation concluding its advantages, insufficiencies and prospects for the future.
