The aim of the study - following a short historical overview - is the Directive 2005/29/EC of the European Parliament and of the Council of 11 May 2005 concerning unfair busincss-to-consumer commercial practices in the internal market, the interpretation of its provisions and its analysis; the exploration of problems connected to its domestic implementing. Not exaggerating to claim that the Directive opened a new chapter for the European Union's consumer protection law in its history, since a regulation depending on the soil of the maximum harmonization with a horizontal character was not born yet till now in this area. In the paper we emphasize the accurate definition of several concepts regarding the virtue of the Directive (for instance: unfair commercial practices, aggressive commercial practices), what may provide help in the liquidation of the heterogeneous member state practices. We draw attention at the same time to the difficulties that may be borne when instead of defining the meaning of the average consumer, the ECJ's case-law is adapted. We examine in connection with this the European Court's case-law, and the affected German and Hungarian legal practice. By the result of the analysis appears a well informed and circumspect consumer, whom the community law protects, but is not its legal guardian. We may observe how the previous protectionist German practice was matured to the expectations of the Court's case-law. We point out the sensitive points of the Hungarian practice. Through the investigation a differentiated consumer model is outlined, in which besides its independence and responsibility the increased protection of sensitive groups and areas come to light. Our final conclusion is that a balance between the expected consciousness - protection of the consumer model applied by the competent organs has to adapt flexibly to the socio-economic changes.
