Abstract

A significant portion of the latin type notary activities belong to market participants also in Hungary, especially in editing documents, even if it is circumscribed and round-defined by law and limited by business rules. The responsibility, as a legal norm has three aims: protection, prevention and repairation functions. According to economic theory, the professional liability insurance like any other insurance, is based on the customers' risk aversion, and the customers limited rationality. The professional liability insurance, and the involvement of the insurance company not only reduce transaction costs for the insured in the claim adjustment, but reduce transaction costs between insured and its business partners as well. Even though the risk-averse behaviour does not signify the largest impact of the legal requirements, but also the conclusion of the mandatory liability insurance. This is equal to the performing notary activities in the regional market as well, whose area of responsibility is similar to the jurisdiction of the district court's.
