Abstract
In Hungary, the Tending (Supplemental) Contract has been regulated in the codification drafts of Civil Law at the turn of the 19th and 20th century. The reason behind this was partly due to everyday lifestyle and partly because of the German pattern of codification. At the same time, the roots of Tending Contracts can be found in the Civil Law relations of the feudal era. It was mainly influenced by Widowhood Law, which meant that any widowed woman was entitled to proper tending and supplements based on her rank, and as long as she kept her late husband's name, she could live in his house. Such sales contracts, where the buyer expressed obligation that the seller of the property will be sustained and will be provided with housing as long as the buyer is alive, were mainly written during the squire society at the end of the 19th century. Since the Austrian Code of Civil Law did not regulate the Tending Contract, only the similar Life-Interest Contract - and it was considered a hazardous contract -, the judicial practices were the real creators of the system of norms which characterizes these type of contracts even today.
