Abstract
One of the new legislation methods of the new Labour Code (entered into force on 1 July 2012): the Civil Code became the special background law of this Code. On the one hand it can be considered improvement, because previously the sentencing practice – without any provision of the Code – implemented rules from the Civil Code in labour disputes. But on the other hand the regulation method of the Labour Code causes different problems in the field of judicature. The study summarizes the matter of principles of this legislation soluton and the itemized legal problems in the field of legal acts, compensation for damages and the term of limitation for labor-law claims. Finally the paper frames legislation recommendations: the Civil Code might be the special background law of the Labour Code only at the field of protection of rights relating to personality that cases, and in that cases, when the labour rules does not elaborates a legal institution.
