Abstract

This paper has a purpose to put forward a new approach of flexible alteration of employment relationship. The two substantial criteria of an employment relationship are the employee’s legal subordination and long-term nature. The long-term relationship – or as often referred to: a long-term contract – may affect the ability to exactly define the content of the contract, and this is far from being indifferent from the aspect of the possibilities to alter the legal relationship. The term ‘incomplete contract’ and so called ‘relational contract’ do not originate in labour law; however, their interpretation has an increasing significance in labour law too. The substance of the new approach the flexibility and the security is the protection of the legal status of employee. The study describes the different kind of unilateral alteration of employment relationship, the limits of these possibilities. Finally provides an overview of the connection between relation contract and contract of employment.
