Abstract

The concept of undertaking within the meaning of the EU competition rules is relatively broad. As a rule, the undertaking is responsible for the conduct of its employees. Conversely, a selfemployed person may be seen as an undertaking in its own right. It becomes increasingly difficult in today’s economy to differentiate employees from self-employed and, hence, to define the concept of undertaking and its responsibilities under EU competition rules. The present article discusses these difficulties in the light of the recent ruling of the European Court of Justice in the FNV case (C-413/13).
