After the Austro-Hungarian Compromise of 1867, the establishment of the constitutional political system was one of the most important goal of the National Assembly. After the restoration of territorial integrity of Hungary, formation of the unified public administration system and the modern jurisdictional organisation was needed. The Article 1. of Act IV of 1869 declared, that the public administration and jurisdiction are separated, moreover, determined the condition of becoming a judge, the regulation of incompatibility and the questions of judicial responsibility. The paper demonstrates the practical enforcement of this legal provisions on the basis of archival sources of the Court of Appeal of Szeged (Szegedi Ítélőtábla), especially in regard to Court of Justice of Szeged (törvényszék) and the district courts (járásbíróság) under the territorial jurisdiction of this institution.
