Abstract
In recent years, there has been a strong interest in the so-called unmanned aircrafts, commonly known as drones, due to the fact that innumerable types of such devices are already commercially available and have a very wide range of civilian purposes. At the same time, the explosive technological development has not been followed by the development of the regulatory environment, which is undoubtedly essential, since the use of unmanned aircrafts affects many areas of law, from private property protection, personality rights and liability issues to criminal law. The purpose of this study is to review the rules governing the operators of unmanned aircrafts and their operation. I consider this study to be of a particular relevance given that, following a lengthy legislative process, two EU Commission Regulations have been published in March and May 2019, laying down provisions specifically relating to unmanned aircrafts. The cited Commission Regulations are the Commission Delegated Regulation (EU) 2019/945 of 12 March 2019 on unmanned aircraft systems and on third-country operators of unmanned aircraft systems and the Commission Implementing Regulation (EU) 2019/947 of 24 May 2019 on the rules and procedures for the operation of unmanned aircraft. Regulation 2019/945 lays down provisions on unmanned aircraft as products, while Regulation 2019/947 should be applied to the operation of such devices. The latter regulation will be applicable in all Member States as of 1st July 2020, so it is necessary to review the Hungarian regulatory environment and the need of amending it.
