The world economic crisis in 2008 has evidenced that the EU economy shall necessarily go through fundamental changes. The Europe 2020 strategy has been developed by the European Union in order to reach and sustain economic stability. Among many areas of interventions named in this strategy, this paper is dealing with the priority called Smart growth: developing an economy based on knowledge and innovation. This paper is investigating the opportunity of building an innovative economy pertaining to the area of the pharmaceutical industry due to its highly innovative power. The essence of pharmaceutical innovation is the pharmaceutical invention, called the innovative medicine which has a potential to make a huge profit to innovators. Beside this, and it has a positive effect on the economic growth of the European Union. Based on these characteristics, the economic support of innovative medicines is indeed well-founded and is typically granted in the form of patents. Though, according to recent researches, there is a tendency showing that pharmaceutical patents are used in an abusive ways by innovators in order to keep up market exclusivity. This method can have a bad influence on the economy of the European Union and the nations. Taking into consideration the economic background mentioned above, the aim of this research is to identify the problematic parts of the patent system and provide a proposal that might be appropriate to establish a system, based on legality, equality, and scientific and technological development. For this reason, after defining basic concepts, the research analyses the attitude of market players which infringes intellectual property law and names obstacles that are in the way of progress. Second of all, offer a de lege ferenda legislation that might be suitable to remove these obstacles from the patent system. Finally, some summarizing statements can be found in the final part of this paper.
