Abstract

The framework of legal regulation affecting medical and biomedical ethics is given by fundamental human rights, with some additions from the field of science ethics. The reason being is that the protection of human life and dignity are the starting point and main circle of interests of both areas. As a consequence of its definition as a general right of personality, new rights can be derived from the right to dignity. From the right to self-determination, the Constitutional Court has defined the right to selfdetermination of health, which includes an almost complete right of disposition over medical interventions, and its main component is the information-based consent in the relationship between the physician and the patient. The further named right, derived from the right to self-determination, is the informational right of self-determination, the scope of concepts of which includes the right to the protection of personal data. At the boundaries of jurisprudence, we can meet a number of issues that require that results from other science disciplines also be considered for better understanding of these issues and for establishing proper regulations to address these issues. One of these issues is the correlation between the right of self-determination and medical science and biology, and furthermore bioethics that link these issues to jurisprudence. The evolution of genetics gives jurisprudence continuous challenges and areas to regulate including the right of self-determination as its sub-individual approach is indispensable for creating the appropriate legal background.
