Abstract
The dissertation relates to those questions of classification and delimitation that have not been answered yet either by the academic writing or by jurisprudence. The considered issues were defined based on thirty-six judicial decisions. The analysis and interpretation of these judgements give the backbone of the dissertation. The questions drawn up in the introduction are closely connected. Szegedi Ítélőtábla submitted a motion after two of its councils gave opposite conclusions. The core of the question is whether the degree of organisation or other elements give the delimitation of criminal conspiracy and criminal organization. However, the answering of these questions raises further issues inevitably. First of all, it is indispensable to determine the accurate meaning of ‘coordinated operation’: does it suggest a higher level of ‘organisation’ or is it equal to the organisation of criminal conspiracy? Beside the empirical studies, I have also applied the method of semantic and purposive interpretation to seek answers to these questions. During the analysis of judicial decisions, further anomalies could be observed: the confusion of legal and non-legal terms, and the inappropriate application of international legislation. The summary of the conclusions outlines a possible conception which may give a solution to the anomalies existing in jurisprudence.
