In my paper I deal with the questions of the doctrine of the same acts and I examine how it affects the application of the ne bis in idem principle. The reason why I thought it was necessary to write about this time is that this main question determines the extent of such cardinal principles as the function of arraignment and sentencing and their correlation to each other, the right to defence, the principle of accusation, and the ne bis in idem principle. I analyse the tendency of the doctrine of the same acts in view of the correlation between the jurisprudence and the judicature. In my writing I not only examine the relationship of the indictment and the judgement, but I also deal with the problem of the accusation after the legally binding judgement. So I am looking for the meaning of the ‘idem’ component. The marking out of the doctrine of the same acts’ limits influences the extension of the ne bis in idem principle and the proportion of the extraordinary remedies and the new procedures. In connection with the ne bis in idem principle, the difficult question is what is meant by ‘same’ in the criminal procedure. Therefore, the Hungarian judicial practice is presented. But the comprehensive examination is indispensable for the elaboration of this complex theme, so I also made an international analysis concerning the case-law of the European Court of Human Rights and of the Court of Justice of the European Union.
