Abstract
I started my research with the question, which is visible in the subtitle of the essay and I was looking for the answer to whether a social expectation could regulate the legal norm. The examination of the legal status of the duels in the XIX-XX centuries perfectly demonstrates that it knows. The duel was a widespread dispute settlement method for the retaliation of defamation in the XIX-XX centuries. In my essay, I have shown that this phenomenon has pervaded our entire modern legal system, especially the European continental legal system. As a conclusion, it can be deduced that the duel was not suppressed by prohibitive provisions, but by people’s thinking changes that were caused by major social phenomena. What I have in mind is, for example, the parties which are opened up to the new masses and the terrors of the wars. During the research, firstly, I defined the basic concepts that were essential for the further dissection of the subject. Secondly, I studied the international legal sources and then I considered for the Hungarian regulatory systems. Finally, I presented the application of the legislation in practice.
