Abstract

The topicality of the theme lies in that the Council of the European Union adopted an amendment to the Audiovisual Media Services Directive (AVMSD) in November 2018, in the context of the Digital Single Market Strategy. The aim of the thesis is to point out that the relationship between technological development and law makes it increasingly necessary to adjust the material scope, which is typically based on the appearance and the spreading of a new platform that cannot be incorporated into the existing concept. To outline this, I consider it indispensable to sketch out the history of the directive. Recent European Court of Justice and Member State judicial practice helps to highlight the reason of the modification and underpins its necessity. I outline the advantages and disadvantages of self- and co-regulation as an alternative legislative path, as the support of the Member States and of the EU can both be found in the directive at the moment and previously as well. Starting from this point, in the last major part of my paper I will introduce the general terms and conditions of the most common video-sharing platform of Hungary and also that of the world, which is governed by common law, and which policies and guidelines strongly reflect the regulation of the AVMSD. The final conclusion of the paper is the accelerating spiral cycle, which is also indicated in the title, from which, if the legislator is not interrupted, it foresees an increasingly frequent amendment of the directive.
