Abstract
La aplicación de plaguicidas en predios cercanos a barrios poblados afecta gravemente la salud de la población residente, y en un fallo condenatorio ejemplar –en septiembre de 2012– la justicia penal cordobesa se expidió al respecto, sentencia confirmada tanto por el Tribunal Superior de Justicia de Córdoba como por la Corte Suprema de Justicia de la Nación el 12 de septiembre de 2017. La Cámara Primera del Crimen, entre sus considerandos advierte que el barrio Ituzaingó Anexo –afectado y objeto del fallo "Gabrielli Jorge Alberto y otros P.S.A. Infracción Ley 24.051"–, había sido declarado en emergencia sanitaria desde 2002 y quienes aplicaron los plaguicidas sabían que estaba vigente la emergencia sanitaria y que se registraba allí una delicada situación en materia de salud pública. La sentencia fue dictada en septiembre de 2012 y confirmada sucesivamente en 2015 y 2017. Palabras clave: medio ambiente, salud y medio ambiente, responsabilidad penal.
