Abstract

In 2012, the new Hungarian Constitution and the new law on Churches came into force. The new rules signify a paradigm shift concerning the practices of Churches. This paper compares the prior legislative with the law currently in effect. After the democratic transformation, the separation of Church and State is explicitly stated in the Constitution of Hungary. Neutrality is the most important principle with respect to the freedom of conscience and religion, Churches and other religious or ideological organisations. The State should remain neutral in questions concerning ideology, and should not identify itself with any ideologies and religions. The concept of neutrality is elaborated by the Constitutional Court in some decisions. However, the principle of neutrality may seem broken in practice by the Government or Parliament. Churches receive a direct subsidy from the budget to fund public services carried out by them (e.g. education). Churches receive more support than the other non-governmental organisations (NGO’s). The level of support can be different in diverse sectors (public, non-profit, Church). In legislation, the principle of equal funding and sector-neutralism is not adopted. The new Hungarian Constitution does not underline the separation of Church and State, but the cooperation between State and Church. The new Constitution has a Christian ideological position, and the Christian morals are distinguished from other ideologies. The State ensures an active role for traditional Churches and some privileged Churches in carrying out public services. Consequently, the neutrality is not adopted by the legislative.
