The study expounds how it was possible to adopt a child for same sex couples in Hungary. The manuscript was closed as of the end of May 2020 thus the study presents the legal environment and dilemmas of that time. It is very important to be recorded that the legislator planned to change the relevant law as of November 2020. This modification overwrites a relevant part of the study. However, the study also expounds the legal history of adoption from the Roman age and the short legal history of same sex partnership in Hungary. These parts, obviously, are still valid. After the historical parts, the study presents the legal environment which was in effect at the time when the manuscript was closed. The legal environment is followed by the point of the paper which is the constitutional and also moral dilemma caused by the earlier and also by the current regulation. Same sex couples cannot marry in Hungary thus they could not adopt a child as a couple but one party of the couple could do it. Now, based on the new legislation, it is not possible anymore even alone. The main question of the study is whether it is constitutional to restrict adoption for same sex couples based on the reason that they can not be married. The study presents arguments pro and con but it also takes side in this legal and moral question.
