Abstract
In the case-law of the Court of Justice of the European Union (CJEU) there is a coherent sub-category in relation with the right of access to documents. The right of access is one of the very important fundamental rights of the EU citizens, which is regulated in Article 15 of the Treaty on the Functioning of the European Union, and also in Article 42 of the Charter of Fundamental Rights of the European Union. The aim of the legislation of this right is to give effect to the principle of transparency, under which all official documents of the EU institutions should be made available to the public. However, the EU documents may contain personal data, so access, disclosure of the content of these documents raise a lot of question in practice. Therefore, the aim of this paper is to examine the related case-law of the CJEU to offer solutions to these problems. The relevant cases of the General Court and the Court of Justice illustrate the conflict of the fundamental right of personal data protection with the right of access to documents and moreover, with the freedom of information and transparency. This work analyses step-bystep the development of the case-law of the CJEU in this field. Based on this, it can be stated that by giving the important role to the CJEU of interpreting the EU provisions, there is a multi-stage examination method, which should be followed by the EU institutions, when they decide to give access to their documents containing personal data.
