Abstract
The prohibition of discrimination in Hungarian law is based on Article 70/A of the Constitution. The Constitutional Court has — since the first year of its work — been dealing many times with various aspects of the concept of non-discrimination. With the accession to the European Union, Hungary was obliged to transpose a body of community legislation concerinig non-discrimination as a part of community acquis. This obligation resulted in the adoption of Act CXXV of 2003 on equal treatment and the promotion of the equality of chances. This study examines to what extent the concept of non-discrimination appearing in the jurisdiction of the Constituitional Court is in conformity with the concepts of the relevant European legislation. This is of special importance as the principles elaborated by the Constitutiona Court are still guidelines for the legislator and the judges and authorities executing the new law. However, if Constitutional Court-principles offer a lower level of protection than community law does, these principles have to be overwritten by the concepts of the latter. In the context of the above, after presenting the non-discrimination jurisdiction of the Constitutional Court in general, the study concentrates on the concepts of indirect discrimination, positive discrimination and reasonable accomodation.
