Abstract

On the one hand, this paper relates to the studies on knowledge and opinion about law (KOL), one of the key research areas of legal sociology. On the other hand, it fits into the framework of an ongoing exploratory research that examines the legal perspectives of homebirth with an empirical and sociological approach. In Hungary, the relevant legal regulation has made it possible to choose planned homebirth as an alternative to institutional childbirth since 2011. By settling the legal status of homebirth, parents now have the opportunity to choose the place and circumstances of birth relatively freely. However, this option also means increased responsibility, as it also raises medical and legal issues that are difficult to understand as laymen. There is still no consensus on the assessment of risk factors related to the place of delivery, despite the fact that several international studies have concluded that by low-risk pregnancies there is no difference between expected home birth and institutional birth in this regard. In the early stages of the research, mothers, who do not have a law degree and gave birth to at least one child in their home or in a birthplace with the help of professionals, reported their experiences on childbirth through qualitative interviews. The study aimed to understand the main reasons why the participants chose home birth and whether the current legal status of home birth played a role in their decision. The primary goal of the research is to map the information ‘channels’ through which the participants collect information on their possibilities and rights related to childbirth. It attempts to analyze the process of communication between the participants and society, and its effects on KOL.
