While enquiring the conditions of limitation of the human rights we try to find answers on such fundamental questions such as where the borders of the people's freedom are, in what way and to what a measure can the limitation of freedom be justified, and where does the impermissible limitation of freedom start, in other words what are the "limits of the limitation"? The present publication demonstrates that both the international conventions and the so called "basic principle test" of the Hungarian Constitutional Court ("necessity and proportionality test") allows the limitation of the human rights on the basis of the public interest (public order, public security, public morality etc.). Both the standpoint of the theory and the practice is uniform that abstract public interests can not serve as a basis for a limitation in a greater measure than the protection of others' basic rights, thus the aims of the limitation are not equal. The greatest problem is that the definition of the public interest that is used is the practice is empty, undetermined, so the constant referring on it leads to an arbitrary regulation, to the crippling of freedom and private sphere. The state, the legislator and the public administration often likes to indicate itself as the original embodiment of public interest. However, the examination of the public interest's subject-matter was both on the level of legal regulation and in the judicial practice cancelled. The publication presents some important Constitutional Court decisions, in which the reference on public interest has played a significant role. The citations proves as well that the Hungarian Constitutional Court intentionally ceded the right of determination of the public interest's subject-matter to the legislator. In the legal literature only András Sajó made an "attempt to give meaning" at taking the definition of the public interest.
