Abstract
The author regarded the inquiry of internale relations in the business association and the co-operative as a kind of legal person as his task. The aim of the inquiry was to investigate how the components of personal association and capital association take up their position at a economy company or co-operative. The inquiry covered the cogent and dispositive provisions of the regulation. Regulation of the new Civil Code is in progress in Hungary. According to the result of the inquiry, the legislator's task is to decide how the Persons section should be completed by adding the rules related to cooperatives. It is possible to manage co-operatives as an independent category or could be regulated by the Company Act. In his opinion the co-operative does not belong to the group of the business association. In order to ratify this statement the interests of co-operatives should be defined by recording their aims. However — unfortunately — these claims are not supported by neither the Hungarian nor the European regulation showing very diverced picture.
