Abstract
In our study we try to give a complex introduction of the cases in which the public guardian authority can order guardianship. The first part is based on our research into the history of law. At the beginning in Hungary the provisions related to guardianship were regulated together with those of the wardship. This is also typical of Werbőczy's activities in which the wardship is an issue of secondary importance to guardianship. He hardly took over the guardianship related Roman statutory rules or they were mistakenly interpreted. In our historical discussions we explain the different cases of the first Hungarian guardianship law imposing judicial interdiction — XX Act/1877 — which already gives an exact definition of guardianship. We also deal with the reasons for the 2001 year amendment of the regulations of the Civil Code referring to the disposing capacity guardianship and the appointment of a guardian. In connection with this we introduce stages of regulation by order related to the appointment of a guardian having no bearing on disposing power in chronological order. The main point of our study falls to the explanation of the prevailing regulation related to the appointment of a guardian referring to the law enforcement practice of the analyzed public guardian authorities.
