Absztrakt (kivonat)

The death penalty is one of the most ancient legal sanctions, the emergence thereof is coeval with the beginnings of the evolution . ;of. formal law. Up to the Enlightenment capital punishment was a regular sanction (poena ordinaria) for the majority of the felonies nearly every time and : everywhere and this claim is especially true for the antiquity. The present paper wishes to introduce the capital punishment regulations of the main antique legal systems: . Firstly, I am going to examine the Babylonian law with especially regard to the Code of Hammurabi, the Mosaic law . in the Torah and the Talmudic Jewish law. Thereafter I will analyze the Chinese law, the Ind law (Manu's Code) and the Islamic law rulings concerning this legal :institution. Finally, I will briefly introduce the history of the death penalty in the Roman law from the Regnum Romanum until the end of the Roman Empire.
