Abstract

In spite of that there is a wide practice in international law in connection with diplomatic protection, maybe this legal institution is one of the most ambivalent at the same time. The International Law Commission during his codification of the topic in many times uses the practice of international courts, in particular of the International Court of Justice in order to solve these inconsequence and questions. But the practice of international courts in connection with diplomatic protection mostly during the last years has met new challenges and questions. The human rights protection based on international treaties and the system of arbitration for settlement of disputes arising from foreign investments on the one hand are in competition with the traditional diplomatic protection, on the other hand the states, who are exercising diplomatic protection, more and more claim for the individual rights and interest. This work analyses how the International Court of Justice tried to adapt to the changed international situation and in which direction the practice moved in the cases from the new aspects (LaGrand and Avena). This publication seeks an answer for how the "lex specalis" arbitration uses diplomatic protection, and whether there are experiences where the two legal institutions support each other. This supplementary usage of the institutions would be the adequate and satisfying solution for the special rapporteur of the International Law Commission and for the legal community also, and at the same time would be the most effective instrument in the human rights protection. Thus the diplomatic protection could justify his relevance in the future system of dispute settlement also.
