This paper provides a new, fundamental rights focused approach to the analysis of the universal and regional sources of law concerning prostitution and prostitution-related offences, with special regard to the case law of the European Court of Human Rights and the European Court of Justice. As an introduction, I analyse the dogmatics of the topic while reflecting on the moral and law enforcement aspects of prostitution as well as portraying the general theories related to the regulation of the phenomenon. Reglementation aims for creating possibilities for women who are legally engaged in prostitution to be under medical supervision, and also to be registered by the police for their own protection. Secondly, the model of prohibition forms an alternative, which calls for criminal prosecution of violators of the general ban on the phenomenon. Also, various combinations of these theories are present worldwide, leading to a greater significance of the sources of international law regarding prostitution. Following a thorough examination, I create an original classification according to which persons involved in prostitution are in the focus of the relevant sources of international law and consequently identify a number of overlaps and gaps in the human rights safety net of prostitutes. To summarise my consequences I compile a comprehensive table and formulate de lege ferenda proposals, bearing in mind the requirement of resolving the conflict between the prohibition of slavery and forced labour in connection to prostitution and the freedom to choose an occupation and right to engage in work.
