Abstract

The decision whether to allow a child to live in prison with his/her mother involves two options: do you separate a child from her/his mother or have the child live in prison? Most countries allow children - in limited circumstances — to live in prison with their mothers. There are always limited on how long this can be for, so that when children reach a particular age or developmental stage, they have to leave, but rules about when children must leave prison frequently include some flexibility to allow them to stay longer, if the mother herself is shortly to be released. Most countries agree that there is a point after which the negative effects of being in prisons (the restrictive environment, few or no other children, lack of the contact with the rest of the family) outweigh the positive of staying with an imprisoned mother, but they don't agree when the age is. So this age range varies widely (from a few days to six years). At one end of the spectrum there is Norway, which bans children living in prison. The conditions in which children in prison live vary widely between, and sometimes within countries, but almost all countries treat children living in prison differently from the rest of the prison population. Most countries in Europe only allow children to live in prison if there are specialist mother and baby facilities. This study examines the situations which permit children to live in prisons and the practices that exist before, during and after imprisonment.
