Abstract
Controlling the child welfare guardians is partly the task of the child welfare consultant, whereas in a complex way it is the task of the court of guardians. The child welfare consultant is not directly a guardianship controller, his duty is mainly to provide the child welfare guardian with technical and methodological help in performing his educational and custodian duties. In the article I mentioned that in certain countries — in France or Portugal — in case of private guardianship similar duties to that of the of the guardianship controller are performed by a member of the family council in the form of guardianship controller and consultant. The Hungarian national operative legislation does not recognize the institution of the family council, but in the case of the child welfare guardianship it has a less significant importance. I have mentioned the legislative inaccuracy which at the time of introducing the legal institution made it difficult for the child welfare consultant to adapt himself to the professional care. The legislator amended the original legal regulation and defined the task of the guardian advisor and guardian controller with appropriate accuracy. As a result the cooperation between the guardian advisor and the child welfare service has become consummate and the adapting readiness of the child welfare guardians has also changed significantly. According to the operative legislation the child welfare guardianship controller's task also covers the activity of the child welfare guardians. When making a legal statement in respective to the child welfare legal representation the guardians would need the help of the advisors. Due to the deficient erudition of the guardian advisors, they failed to provide sufficient help in this, and also the necessary assistance in property management. It would require a separate article to discuss the responsibility of the child welfare advisor when giving advice in such questions, whereas the responsibility of the child welfare guardian is adequately circumscribed.
