Abstract

The complaint is a specific legal remedy in the part of investigation and indictment preparation of the criminal procedure. The announcement of complaint allows to avoid wrong and possibly wrong decisions, measures and the miss of measures which were adjudged by investigation office or by public prosecutor. The rules of complaint’s law were changed in the past few years by the legislative power. The legislative purpose of the changes were to make the procedures faster and decrease the weight of the public prosecutors. Firstly, the changes clearly narrowed the circle of entitled. But after that the legislation has already guareented the complaint for the denouncer central administrative agencies. And since 1st of January 2014 the legal remedies in the course of the investigation have already changed, which changes have enlarged the possibility of complaint. The Constitutional Court already examined a part of the new complaint’s rules in the decision of 166/2011. (XII. 20.), but even so it could be questioned whether all of the newer changes would pass a repeated constitutional test. Because of the sequential changes the question arises whether the complaint is damaged in merit or not? For example, has the non-victim denouncer’s complaint damaged? The changed rules of complaint bring to light the supervision of the investigation and the supervision right of public prosecutor which is guareented by the Section 20 of Act CLXIII of 2011 on Public Prosecution Office. In my paper I’m writing about complaints which could be filed against decisions and my most important concern is whether the denouncer’s complaint is damaged or not?
