Abstract

A country’s constitution includes fundamental rights, norms embracing society, and provisions regulating the relationship of an individual and the state, that job pervade and define the entire legal system and its development, thus inspecting it can be considered relevant at any time. My main focus in the study is to find out whether the Fundamental Law of Hungary that came into force on the 1st of January in 2012, will bring any difference in comparison with Act XX of 1941 concerning the right to choose employment and occupation freely. In addition, my aim is to provide an answer to the question whether in the Fundamental Law there is simply more attention and emphasis placed on the objectives specified by the state - to create a work-based society, or if it is accompanied by a work obligation imposed on the whole society based on Paragraph 1 of Article XII of the Fundamental Law as well.
