Absztrakt (kivonat)
As a response to the Laszlo Magyar v. Hungary judgment (application no. 73593/10, judgment of 13 October 2014) the Legislator introduced the mandatory pardon proceeding of prisoners sentenced to life imprisonment without the possibility of conditional release as a new proceeding into the Penal Execution Code (Article 46/A-46/H Act CCXL of 2013). The paper shows this new legal institution. The study also presents problems of elderly prisoners given that the above mentioned new procedure mainly affects this group of the prison population. It is an essential question whether the Hungarian penal institutions are prepared to the detention of elderly detainees.
