The CXLIV. 1997. law about registration system of properties accepted by the Parliament on 2 December 1997 and became valid after a one-year delay on 1 January, 2000. The law considers unchanged those classical basic principles which arise from the cadastral register and so far have described the registration system of properties. In my study, I'm looking for the problems arising from the topics of registration, public authenticity, publicity and principle of documentary in real life. From the aspect of the practical importance of the registration system of properties. I emphasized the four most important basic principles which seldom can be separated from each other because they have parallel effects . The essence of the principle of registration is in connection with the legal effect of registration and notice as it results or restricts the public authenticity, the most important effect of the registration system of properties. I'm looking over their legal effects in detail. The principle of publicity basically helps the success of the principle of public authenticity as the people have proper information on indicated data, registered rights and noticed facts if the law attaches proper publicity to the registration system of properties. But according to some authentic parts of the registry the law doesn't assure a full-scale publicity so it restricts public authenticity. In spite of the fact that during the previous restriction a legislator was more precise in wording the principle of public authenticity and endeavored to protect the honest aquisitors, the public authenticity didn't completely succeed. It would necessitate the reduction of the limits of public authenticity that would be imaginable with more unambiguous formulations specifications and with the decrease of some of the stages of legal relief system in the process of registry. The other solution would be if the would declare public authenticity in those cases when the limits undoubtedly can't prevail. Above all, the principle of document serves the success of the principle of registration but on the other hand its rules demand more and more strict formality — regarded to the increase of property-trade — became the device of establishing and maintaining of rule of law and legality. In a wider sense the use of written records in itself means the limit of contractual freedom but the demand of rule of law makes it more reasonable. The question in this sense is how far this restriction can spread or in what way can the obligatory elements of the contract be prescribed or in case of omission what kind of punitive sanction does the law use against defaulters. The new law takes legal practice into consideration and tries — especially the enrolment on computer files — to modernize certain institutions and to eliminate the obsolete dispositions. The widespread possibilities secured by computer using weren't forgotten by the legislator and basic principles that were developed and established in Hungarian law system were built in the law. The success of basic principles compared to so called "Itvr." came rather to the front but didn't plug gaps and uncleared questions also remained in other parts of law system. The uncertainty in public authenticity and in question of delivery can rather cause problems which must be rethought in the possession of practical experience.
