The history of the Middle East is really rich and its cultural heritage is unique and irreplaceable. This region is also known for the armed conflicts that have taken place there. And armed conflict goes together with the destruction of cultural heritage, usually motivated by showing power. The recent armed conflicts in the Middle East have not only had civilian casualties but also the cultural heritage have suffered serious damage. Above all, the Iraqi and Syrian properties are in constant danger, in consequence of the acts of the Islamic State. This terrorist group intentionally and systematically destroyed countless cultural objects or sold them on the black market to finance its military activity. Several international agreements securing the protection of cultural heritage and some of them even state criminal provisions in case of destruction. Also, the Rome Statute of the International Criminal Court (ICC) punishes these kind of acts as war crimes. Nonetheless, we can rarely see a case where a court find the perpetrator guilty in destruction of cultural heritage. In this paper I delimit the most common definitions we can find in international agreements: cultural property and cultural heritage. I also demonstrate the history and present of cultural heritage protection. After that, I present the damages in cultural heritage caused by recent armed conflicts in Iraq and Syria. Finally, I examine the possibilities of criminal procedure in case when the national level cannot act and the ICC does not have jurisdiction to act.
