Abstract
Be it nomadic tribal structures or modern democracies, it can be argued that the administration of justice is a community act, with an indispensable part being played by the individual. Members of a community were and are present in the proceedings, but not only as “controllers”, but also in concrete, distinguishable procedural roles, either as plaintiffs or defendants. The protection of the rights of these persons is quintessential in the respective procedures. In this paper, I examine the relation between the right to remain silence and the publicity of criminal procedures. Through the media, society often condemns someone before either the court delivers a first-instance decision or even a prosecution. However, the major part of the society does not have sufficient knowledge about our legal system, so in these cases, they rely solely on leaked information and their own moral convictions. What is the price to be paid by the defendant who decides to remain silent? How can the media through publicity persuade society to make a judgment based on a sense of morality? According to the practice of the Supreme Court of the United States and the European Court of Human Rights, the right to remain silence sometimes comes at a price.
