Absztrakt (kivonat)
„ When the legislative and executive powers are united in the same person, or in the same body of magistrates, there can be no liberty [...] there is no liberty if the powers of judging is not separated from the legislative and executive [...] there would be an end to everything, if the same man or the same body [...] were to exercise those three powers. Montesquieu described the division of political power among an executive, a legislature, and a judiciary branch. With the idea of separation of the unified political power Montesquieu laid down the principle of democratic statehood which has always been referred to as the basic of a democratic functioning of the State even if the theory has been completed with other branches of power through the years. The European Union is a supranational polity, and is neither a country nor a federation; but as the EU wields political power, and is fully aware of its „democratic deficit“, it attempts to comply with the principle of separation of powers. The EU ’s desire to enhance the democratic and efficient functioning of the institutions further so as to enable them better to carry out, within a single institutional framework, the tasks entrusted to them, confirming its attachment to the principles of liberty, democracy and respect for human rights and fundamental freedoms and of the rule of law and promoting democracy in non-EU member states, cannot render itself independent of the basic principle of Montesquieu. The original competences of a member state are distributed in a complex system of checks and balances between the EU institutions and between the latter and institutions of member states. This system of so called horizontal and vertical separation of powers is analysed in the following essay.
