The quality and effect of the proceedings of the defense counsel will be discussed in this essay. The institution of the assigned counsel is a very significant aspect of this topic. Based on some theoretical considerations we have attempted to point out the differences between the attitude of a chosen and assigned counsel. Thus we have studied whether an effective defense could be enforced by the rules of criminal procedure. We consider the defense counsel (including the assigned counsel) in theory and practice as well. Afterwards a brief history of the Hungarian criminal procedure and other relevant rules will be presented. In connection with this the results of a research by questionnaire will be set forth. After pointing out the shortcomings we propose solutions for the important problems.
