The present paper — as indicated in the title — tries to provide an overview on the rules of compensation for unjust custody and imprisonment under remand in the 1896 Criminal Procedure Code of Hungary. After the introductory part, in part 2 the author introduces the contemporary theories on the legal nature of compensation within the criminal procedure, focusing on the three main tendencies, mentioning the most famous representatives. This is followed by an international outlook, showing how the question of compensation was handled by the legislations of European states. Part 3 of the paper introduces the specific rules of the 1896 Hungarian Criminal Procedure Code in the issue. The author — while examining the legal regulations — runs in parallel with showing the relevant decisions of the Curia (Supreme Court of Hungary) in cases where the question of compensation emerged. The commentaries of contemporary legal theorists, such as Finkey, Auer, Mendel& nyi, and Doleschall also provide us with an excellent remedy in being able to become aware of the discrepancies in the practical effectiveness of the rules, constituted by the Criminal Procedure Code. A special attention is drawn to the critical remarks in the matter by Alfréd Doleschall from 1900, submitted for debate at the plenum of The Hungarian Lawyer's Association. By showing the above regulations, jurisdictional practice and the relevant legal theories on compensation for innocently suffered custody and imprisonment under remand, the author emphasizes that the approach of any state to this question can be considered as a significant evidence on how the legislation handles this area of human rights.
