Abstract

In the past few years the demand arose in Hungary, to establish a new type of jurisdictinal profession, that can reduce the fast-growing workloads of the judges. If the jurisdictional organs employ legal assistants (or Rechtspfleger), it can make the proceedings faster. In the European Union the same problems come up in the early 60's and these problems were solved through the new profession of legal assistants. The author attempts to summarize the history of this profession, from the very beginning in the United States, compares the different types of them in Europe and the United State, and tries to propose necessary solutions to the problems, that still exist in Hungary nowadays as well. Because the education of the legal assistants has started in Hungary only for a few years, therefore it is worth examining the international experiences.
