Abstract

This study concerns the analysis of some general and basic topics in the field of legal interpretation through which the Constitutional Court's understanding of legal interpretation can be characterized - at least, from a certain point of view. Above all, this includes the question of what methods of legal interpretation the Constitutional Court uses, how it identifies these methods, what content it attributes to them; when a legal provision should and should not be interpreted, as well as what is the role of legal interpretation in dealing with conflicts of legal norms. The Constitutional Court uses traditional, conservative terminology to describe and characterize the processes of interpretation (a somewhat improved conceptual system of Savigny's approach). Its practice reflects the conceptual inconsistencies and contradictions we can observe in the (traditional) theories of legal interpretation, but the rulings remain based on the foundations of Savigny's ideas and the Constitutional Court does not seem to intend to use more contemporary and complex approaches applied by modern legal theoretical doctrines. In the rulings of the Court we can run into some contradictory points concerning the methods and terminology of legal interpretation, and the development of more sound and coherent statements, in connection with some interpretation problems, can only be expected in the future. The Constitutional Court also has a couple of doubtful and debatable findings regarding the use of constitutional interpretation rules, especially in connection with the application of Article 28 of the Fundamental Law.
