Abstract

The aim of this research is to examine the preparation of the crime and its conceptual limits. The above mentioned legal institution is the first stage of an intentional crime, but it already includes acts that are manifested in the outside world, since the criminal intent itself is not punishable. The most important part is the examination of the term „undertakes”, which can be found in §11 (1) of Penal Code [Act C. of 2012]. The recently passed Criminal Law Decision No. 3/2019 covers in detail when this behavior can serve as a criminal basis for establishing liability. Furthermore, it is logically connected to the precise definition of the legal term according to a previous ruling of the Court from 2015 (BH2015.322). It loosened the triple set of conditions of this legal institution – seriousness, concreteness, immediacy – did not require immediacy to establish the preparation of murder. The purpose of the thesis is to provide an accurate picture of the role of the preparation stage in criminal law today. In order to define this, it covers the current jurisprudence, and different interpretation methods – grammatical, historical – that make the analysis complex. In conclusion, the Criminal Law Decision No. 3/2019 construates a strong argument system, which prove the term „undertakes” can be attainable unilaterally. However, there are three remarks that show the issues regarding the boundaries of connected criminalized acts. Firstly, in historical context, the thesis sheds a light on the Curia’s misinterpretion of the previously existing laws and demonstrates the importance of interdisciplinary views in jurisprudence. The grammatical aspect is essential when examining the substance of a legal term and the research has successfully used the communication models to achieve this goal.
