Abstract
Legal regulation of intellectual property law feeds on deep international roots. Membership of the European Union in international organizations and conventions throws new light to the effects of the international conventions declared norms on national private law. In some cases, rules regarding international conventions – particularly on copyright law – determine such private law definitions and conditions that have a direct impact on domestic law. Depending on legally protected forms of intellectual property, memberships in international organizations and legal regulation of national laws, various prevalence and legal interpretation on the basis of sophisticated sensitivity can be shown. Method of scientific research is analytical interpretation based on international funds that gives cross-section between international, regional and legal regulation of intellectual property. Primary sources, international commentaries were detected during the research with textual examination of international conventions and secondary legal sources of the European Union in order to reach the greater degree of dogmatic purity. According to the TRIPs Agreement intellectual property rights are private rights. National regulation of copyright law has a highly fragmented character in Member States of the European Union, that doesn’t always mean the application of national norms. Domestic protection of industrial property has to be interpreted in the light of international law in absence of harmonization in the EU. National rules of innovation are based on international universal principles, taking into consideration the requirements of competition law. Some international efforts can be detected in OECD guidelines.
