Due to the emergence of digital technologies the copyright law has faced an unprecedented challenge regarding the validity of the whole copyright regime. The copyrighted works may be copied in an unlimited number without changing the quality of the source and of the copy. This has inevitably led to the emergence of several different phenomena, including the P2P filesharing. Although the national legislators tried to react on these challenges in due time, some new visions on the role and future of the copyright law appeared as well. The present paper introduces two theories that claim that the current copyright regime is inappropriate to deal with the digital world. Kevin Kelly’s digital socialist view and Dmytri Kleiner’s Telekommunist Manifesto equally claims – even if in a different manner – that the copyright law has to be reconsidered rapidly. The paper criticizes both of these theories claiming that both Kelly and Kleiner misses the point and they require a reform of copyright law without effectively presenting any new and workable paradigm instead of the current one.
