Abstract
Global problems (such as climate change, population growth, food and drinking water shortages, etc.) have indicated new challenges to agriculture, which can be solved by technological development and the use of innovative technologies. The constantly changing environmental-natural conditions also have a huge impact on Hungarian agriculture. For this reason, the next stage in its development is precision farming, which is a complex, modern-day production system consisted of several factors. The transition to precision farming is hindered by a number of legal anomalies, therefore the aim of the study is to examine the Hungarian conditions and regulations. The examination of the conceptual definition of precision farming shows that no exact and exclusive legal concept can be given to the phenomenon, given the multitude of conceptual components. Through common conceptual elements, the study focuses on certain area-specific legal problems that hinder precision farming. Precision farming indirectly affects many areas of law, some areas fall primarily within the regulatory scope of the European Union (e.g. Common Agricultural Policy, food safety rules, drone regulations, etc.), while others fall within the competence of the European Union’s Member States (e.g. Land Transaction Act, tax law issues). In this study, among the most significant problems that hinder agricultural development, financing issues related to the Common Agricultural Policy of the European Union between 2023 and 2027, the situation of the Hungarian estate structure and land transaction regulation, as well as other object-specific factors (agricultural drones, autonomous driving technologies, agricultural irrigation) are presented. The aim is to present and reflect on legal problems affecting agricultural innovation regarding precision farming.
