The European Commission and the European Parliament reached an agreement in June 2022 on a common framework for rules to set the adequate minimum wage in the 27 EU Member States. The new EU Directive on minimum wage sets a dual goal: 1. in seeking to reduce working poverty and inequality, it focuses on improving the adequacy of statutory minimum wages, and 2. it encourages the promotion of collective bargaining to negotiate a decent minimum wage. Except for five EU Member States that will keep their collective bargaining system (Austria, Denmark, Finland, Italy and Sweden), the other 22 would have their national parliaments implement a new framework setting the national minimum wage to 60 percent of the country’s gross median wage or 50 percent of the gross average wage. However, it shall be underlined that the EU directive sets a relative minimum wage, based on the adequate minimum living wage in every Member State. It is a point of reference which varies by each Member State. While the rules are non-binding, some fear the effort is counterproductive and could lead to further centralization in Europe. The aim of this article is to introduce the origin and the legal dogmatics of the EU’s Adequate Minimum Wage Directive.
