In this study, we will present the main changes in the regulation of posthumous personality rights, which was caused by the Civil Code which came into force on 15th March, 2014. However, the main topic of this study is the basic hypothesis according to which there is an unsolved conflict between the posthumous personality rights and the right of assembly in the current regulatory environment. The actuality of this topic is the result of the decision of Constitutional Court made in 2016, which stated an unconstitutional fault. Therefore, the national regulation of the right of assembly will be reformed. To confirm our basic hypothesis, we will analyse the upcoming problems by the American and German leading cases and the foreign regulation. Further to that, these will be collated with the Hungarian Right of Assembly Act by the help of comparative law. A number of issues will be analysed by empirical and dogmatic ways. We will examine the changes followed by the Civil Code and the subjective and temporal extent of posthumous personality rights. Moreover, we will examine the related points of human dignity and the time and place of assembly, as well as the necessity and proportionality of the limitations or prohibitions in connection therewith. By using the aforementioned test methods, we will suggest an alternative regulation based on foreign models and on the national specialities. In that, there will be defined the places, the physical and temporal limitations and the exceptions to the general rule. These will provide the proper legal protection of personality rights of the deceased and the bereaved in relation to the right of assembly.
