Absztrakt (kivonat)

The present study discusses the topic of the transmission of Debrecen's public administration in 1848 and later years. In addition to the discussion of the 1848/49 events, based on the principle of institutional succession, it also sums up the events of 1861 and 1867, while devoting some attention to the critique of the functioning of the general assembly. The author examined separately the 1848 and 1849 tasks and achievements of the new general assembly and town management which was partly transformed yet retained quite a number of well-known figures from the previous years' public life. The reason for this is the fact the stay of the government and the parliament in Debrecen placed an individual emphasis in between the respective events. After the revolution in 1848 the city began to develop its public representation in the local general assembly by the first real elections. The author shows how the brand new constitutional instruments operated in the first months in this royal free town. In the spring of 1849, the control over public life in Debrecen was transferred partly into the hand of the government, which fact induced quite an amount of tension in between the general assembly, the local "public officials" and the National Commission on Defence (OHB). It was among these focal points that the author carried out his selection of event also coherent from an aspect of legal history, or their summaries, to be examined. At the same time he did not discuss anew events occurring during the Debrecen stay of the government that had been noted and analysed before by many (e.g., the drafting and evaluation of the Declaration of Independence). The literature on the 1861 history of Debrecen is rather poor, what's more, the legal historical approach is almost totally missing, although the "minor revolution" fought in public law could possibly be illustrated most plastically through an introduction of the evolution of constitutionality and legal institutions. This latter standpoint of the author provided an opportunity for him to devote a detailed analysis to the questions of the legal history of institutions of the period and deal with the evolving theoretical dogmatic discourses, since 1861 events also signify the survival of the institutions and principles established in 1848. The availability of detailed archival materials makes it pos sible to deal with the re-election of officials in 1867 at grater length, whereby the reader gains a fascinating insight into the internal system of institutions of a royal free town at that age. Next, some gleanings from the 1867 history of the general assembly are given, with special emphasis on some episodes of greater significance in legal and constitutional history, namely the complications surrounding the organisation of the common juries, the history of the damaging of the minutes, the adversities involved with the construction of the Debrecen—Szatmárnémeti railway line, and an evaluation of the nomenclature of the neo-absolutist age. The author desired to place special emphasis on the introduction of the opposition's set of ideas which characterised the city of Debrecen in the years following the compromise of 1867. The author believes that both professional researchers and the average readers will find this new chapter of Debrecen's local history beneficial to read.
