The Article aims to analyze the Deckmyn decision of the ECJ from a sole perspective: is parody an independent concept of the European copyright law, and further, is this decision correct? Following the short introduction of the facts of the case the paper shortly summarizes, how different regulations the Member States of the European Union have on the concept of parody. Some countries allow for the parody under a statutory exception, others accept to fit it into other limitations or exceptions. Based upon these information the paper argues that the decision of the ECJ that tightened the definition of parody on two simple requirements did unnecessarily overrule the regulation and practice of Member States.
