Abstract
From 1 January 2018, Act CXXX of 2016 on the Code of Civil Procedure raised the value limit for the mandatory use of the payment order to HUF 3,000,000. But has the legislature set the new threshold correctly? In order to answer this question, it was inevitable to have a historical overview of the Hungarian regulations concerning the legal institution of payment order in terms of changes in the value limits, to present the theoretically possible regulatory models and to evaluate the current rules from the point of view of the applied regulatory model. In view of the multiple currency changes and turbulent economic processes, it was only possible to determine the real role of the new value limit after making the variable amount limits comparable by calculation to present value. Knowing this and the reasons for the modification, I examined the possible solutions and the effects of the chosen value with the help of statistical methods (ROC analysis). I came to the conclusion that raising the value limit was justified, but in order to achieve the goal of the amendment, the legislator could have been more courageous and could have raised it to the HUF 5,500,000-6,500,000 range. But it is not too late today...
